HB 459 Summary

• Amends the Charter of the Town of Ellendale to update terminology (replacing "Councilmen" with "Councilmembers") and modernize municipal governance procedures including elections, meetings, and officer duties.

• Increases the Town's short-term borrowing authority from $60,000 to $100,000 without voter approval and extends the maximum repayment period to six (6) years.

• Raises the maximum penalty for ordinance violations from $100 to $500 and increases competitive bidding threshold for contracts from $5,000 to $10,000 (or the State of Delaware's minimum threshold).

• Expands the Town's powers to create special development districts and tax increment financing districts under Delaware Code Title 22, Chapters 17 and 18, with ability to levy special taxes and issue nonrecourse bonds.

• Establishes comprehensive annexation procedures allowing the Town to annex contiguous territory through petition, Town Council resolution, or special election, with requirements for public hearings, notice, and voter approval for larger annexations exceeding 10 contiguous acres.
