Amend Delaware Code Title 17, Section 146 to add new subsection (g) requiring the Department of Transportation to issue temporary entrance permits to developers within 5 days of application for commercial or economic development projects that include an erosion and sediment control permit.

Temporary entrance permits allow developers to perform clearing and grading activities expeditiously for approved projects.

Developers who obtain temporary entrance permits assume all risk and liability for activities performed under the permit; the state and its agencies are not responsible for harm, project denial, required plan modifications, or failure to issue final permits.

Existing provisions remain unchanged regarding permit requirements for all highway entrances and exits, standards and regulations established by the Department, penalties for violations, and Department authority to install barricades or remove unpermitted entrances.
