All settlement or judgment funds received by the State or State agencies exceeding $75,000 must be deposited to the General Fund and cannot be transferred or spent until appropriated by the General Assembly.

Exceptions allow funds to be disbursed directly to non-State parties to the dispute, consumers entitled to refunds or damages, and attorneys awarded fees under the settlement.

The Attorney General must submit copies of settlements or judgments exceeding $75,000 to the Controller General within 60 days, with confidential information redacted.

The Attorney General must file a written report with the Joint Finance Committee at least 30 days before disbursing settlement funds exceeding $75,000, detailing payment terms and conditions.

Existing Delaware Code provisions that specify different treatment of settlement funds are exempt from these requirements, including funds under Title 6 § 2527 and Title 16 § 137.
