House Bill 86 Summary

• Establishes a new "K-3 Basic Special Education (basic)" funding category for kindergarten through third grade students identified as eligible for basic special education services, which previously had no additional unit funding.

• Implements a three-year phase-in of increased funding by gradually reducing the student-to-unit ratio for K-3 basic special education from 16.2 students per unit to 12.2 (FY 2022), 10.2 (FY 2023), and 8.4 (FY 2024).

• Aligns K-3 basic special education funding with existing grades 4-12 basic special education funding at a ratio of 1 unit for 8.4 students by Fiscal Year 2024.

• Sections take effect on staggered dates: Section 1 on July 1, 2021; Section 2 on July 1, 2022; and Section 3 on July 1, 2023.
