Delaware Senate Bill 111 - The Clean Slate Act

• Creates an automatic expungement process for adult and juvenile criminal cases eligible for mandatory expungement, eliminating the need for individuals to petition for relief.

• Requires the State Bureau of Identification to identify and automatically expunge eligible cases on a monthly basis beginning August 1, 2024.

• Authorizes the Department of Safety and Homeland Security to promulgate regulations necessary for implementation of the automatic expungement process.

• Permits individuals to still file petitions for expungement of eligible records if automatic expungement has not occurred.

• Eliminates individuals' right to sue for damages if the State Bureau of Identification fails to identify a case as eligible for automatic expungement.
