Food establishments prohibited from providing single-service plastic beverage straws unless requested by a consumer, with exceptions for pre-packaged goods and hospital/long-term care facility patients.

Food establishments prohibited from providing single-service plastic beverage stirrers, cocktail picks, or sandwich picks to consumers.

Food establishments prohibited from serving ready-to-eat food or beverages in polystyrene foam containers, with exemptions for pre-packaged food and containers for raw meat, poultry, fish, seafood, or eggs.

Plastic straws must remain available upon consumer request at no charge, and establishments cannot inquire about the reason for the request.

Effective date of July 1, 2023 for the restrictions on plastic and polystyrene products; violations subject to Delaware Food Code penalties enforced by the Department of Health and Social Services.
