Prohibits food establishments from providing ready-to-eat food in expanded polystyrene (Styrofoam) containers, though pre-packaged items are exempt and establishments are encouraged not to stock them.

Bans the retail sale of expanded polystyrene food service products, containers, and packing materials.

Restricts single-service plastic items at food establishments: straws only upon consumer request, and prohibits coffee stirrers, cocktail picks, and sandwich picks.

Prohibits public schools and charter schools from serving ready-to-eat food through cafeterias in expanded polystyrene containers, with encouragement to avoid pre-packaged expanded polystyrene items.

Establishes civil penalties of up to $500 for first violation, $1,000 for second, and $2,000 for third or subsequent violations, with collected funds directed to the Delaware Department of Natural Resources and Environmental Control for enforcement.
