Requires school districts, charter schools, member schools, and higher education institutions to designate athletic teams based on biological sex (male, female, or coed).

Prohibits students from competing on athletic teams designated for the opposite biological sex, as determined by birth certificate or other government record obtained at or near time of birth.

Allows an exception permitting female students to compete on male sports teams only if a corresponding female team or sport is not offered.

Provides students harmed by violations the right to sue for injunctive relief, damages, and attorney fees, with a 2-year statute of limitations.

Protects schools complying with the act from complaints, investigations, or adverse action by governmental entities, licensing organizations, or athletic associations, and allows schools to sue entities that violate the act.

Requires the Delaware Interscholastic Athletic Association to adopt regulations for implementation and becomes effective for the 2022-2023 school year.
