Repeals existing Delaware Code sections on termination of pregnancy and enacts the "Pain-Capable Unborn Child Protection Act."

Prohibits abortion of a fetus at 20 or more weeks post-fertilization age, except when necessary to prevent serious health risk to the mother (excluding psychological or emotional conditions).

Requires physicians to determine probable post-fertilization age before performing abortion, except in medical emergencies, using medical examinations and tests.

Requires physicians to report all abortions to the Department of Health and Social Services, including post-fertilization age, method used, and justification if fetus was 20+ weeks old.

Establishes penalties including Class D felony charges for violations, license discipline for medical practitioners, allows civil suits for actual and punitive damages, and permits injunctive relief by the mother, parents/guardians of minors, or Department of Justice.
