Each school district and charter school must establish a policy prohibiting adult sexual misconduct and any sexual relationship between school employees, contractors, coaches, volunteers and students, including adult students currently enrolled.

Policies must define appropriate and inappropriate interactions between adults and students, establish procedures for notifying the Department of Education and law enforcement of suspected misconduct, and emphasize mandatory reporting requirements under Title 16 § 903.

Policies must include guidelines for preferred and prohibited methods of electronic communication between school adults and students.

Substantiated incidents of adult sexual misconduct must be reported in future employment and volunteer reference checks.

School districts and charter schools must develop hiring practices to screen for adult sexual misconduct in employees, contractors, coaches, and volunteers; effective for the 2023-2024 school year.
