Requires New Castle, Kent, and Sussex Counties to include an educational element in their comprehensive plans that addresses school facility construction and allocation within school districts.

Educational element must be developed with input from local school districts, the Department of Education, and the Office of State Planning and Coordination.

Educational element shall include recommendations for coordinating residential development with adequate school capacity and must account for county code provisions related to school capacity.

Department of Education must develop guidance and policies for implementing these requirements by July 1, 2024.

Counties must include the educational element in their next comprehensive plan update following the Act's enactment, effective January 1, 2023.
