Repeals existing Delaware Code sections (§§ 1790-1792, 1795) relating to termination of human pregnancy and replaces them with "The Pain-Capable Unborn Child Protection Act."

Prohibits abortion of unborn children at 20 or more weeks post-fertilization, when substantial medical evidence indicates the fetus is capable of experiencing pain, except when necessary to prevent serious health risk to the pregnant woman.

Requires physicians to determine probable post-fertilization age through medical examination and testing before performing an abortion, except in medical emergencies.

Mandates that abortions performed on pain-capable fetuses use the method providing the best opportunity for fetal survival, unless that method poses greater risk to the pregnant woman's life or health.

Establishes civil and criminal penalties including Class D felony charges for violations, professional license discipline, private civil actions for damages by the pregnant woman or father, and injunctive relief provisions; requires physician reporting to the Department of Health and Social Services.
