SB5 Summary

• Establishes automatic voter registration system at Delaware Division of Motor Vehicles (DMV) for unregistered adults who provide proof of U.S. citizenship during license or identification card transactions and are otherwise eligible to register.

• Requires DMV to electronically transmit daily records of eligible citizens to Department of Elections, which will register them as unaffiliated voters and send notification with opportunity to decline registration or affiliate with a political party.

• Automatically updates voter registration records when registered voters provide new name or address information at DMV, with notification and opportunity to verify or correct changes.

• Authorizes State Election Commissioner to implement automatic voter registration at other state agencies (Social Services, Labor, Vocational Rehabilitation, and others) that collect sufficient eligibility information.

• Becomes effective two years after enactment or five days after State Election Commissioner certifies systems are functional, whichever is earlier; protects ineligible persons from penalties if registered in error through this automatic process.
