Authorizes the State Bureau of Identification (SBI) to release subsequent arrest notifications to the Department of Education for its employees and contractors.

Clarifies that background check information may be disclosed to the Secretary of Education or the Secretary's designee in addition to existing school officials.

Establishes that the Department of Education, along with schools and contractors, can make suitability determinations for employment or contracting based on criminal history using specified factors.

Allows individuals denied employment or contracts with the Department of Education based on criminal history to appeal to the Secretary of Education for reconsideration.

Makes technical corrections to existing confidentiality and disclosure provisions for background check information in Delaware Code Title 31, Section 309.
