Creates legal protection for individuals who report sexual assault, harassment, or discrimination, shielding them from civil liability for communications made without malice (defined as knowledge of falsity or reckless disregard for truth)

Extends protection to both victims with a reasonable basis to file a complaint and witnesses to sexual assault, harassment, or discrimination, regardless of whether a formal complaint is filed

Entitles prevailing defendants in defamation lawsuits arising from protected communications to recover attorneys' fees, treble actual damages, and punitive damages

Prohibits nondisclosure provisions in settlement agreements related to sexual offenses, workplace sexual harassment, or discriminatory housing practices involving sexual assault, effective July 1, 2024

Allows settlement agreements to protect a claimant's identity at the claimant's request and does not prohibit confidentiality of settlement amounts
