House Bill 33 Summary

• Decreases the student-to-unit ratio for preschool 3+ basic special education from 12.8 students per unit to 8.4 students per unit, effective July 1, 2023.

• Creates a new preschool 2 basic special education unit with a ratio of 7 students per unit for 2-year-olds with disabilities enrolled in school district programs.

• Aligns the preschool 3+ basic special education ratio with the K-3 basic special education ratio of 8.4 students per unit.

• Requires districts to use all preschool special education unit funding to support services for students counted in both preschool 2 and preschool 3+ basic special education units, including employment of teachers, paraprofessionals, speech-language pathologists, and related services personnel.

• Allows districts to use tuition to pay for local share and excess costs of special education and related services for preschool students.
