Expands the exemption from lifeguard requirements to include pools serving residential communities such as apartment complexes, townhomes, and single-family communities, provided the pool is not accessible to the general public

Current law already exempts pools at motels, hotels, and private campground facilities from mandatory lifeguard requirements

Amends Title 16, § 122 of the Delaware Code governing the powers and duties of the Department of Health and Social Services

Aims to reduce costs for private residential communities that would otherwise need to hire lifeguards, which sponsors argue would be passed on to tenants through higher rent

Creates uniform lifeguard requirements across rental communities, homeowner-owned pools, hotels, motels, and campgrounds
