Creates a new Department of Veterans' Affairs headed by a Secretary appointed by the Governor with Senate approval, who must be a veteran qualified by training and experience.

Transfers most duties from the existing Commission of Veterans' Affairs to the new Department, including oversight of the Delaware State Veterans' Home, Veterans' Memorial Cemetery, and administration of the Delaware Veterans Trust Fund.

The Commission continues as an advisory body to the Secretary, composed of 15 commissioners (10 from designated veterans organizations and 5 at-large appointees) that must report to the Secretary, Governor, and General Assembly.

Current Commission employees become Department employees with maintained salary, seniority, and benefits; the Department assumes all contracts, assets, and liabilities of the Commission.

Takes effect 180 days after enactment into law.
