HB 69 Summary

• Eliminates the requirement that beer gardens employ a daily average of not less than 25 full-time employees, removing the only statutory staffing requirement for liquor establishments.

• Adds beer gardens to the list of establishments (alongside taprooms and taverns) for which the Commissioner may deny a license if an existing similar establishment is within 1200 feet in incorporated areas or 9/10 of a mile in unincorporated areas.

• Maintains all other beer garden requirements including minimum 10,000 contiguous square feet, 5 consecutive months operation, 42-inch enclosed barrier, and substantial physical structure costing at least $250,000.
