Amends Section 12, Article I of the Delaware Constitution to modernize bail provisions and allow pretrial detention in certain felony cases beyond just capital offenses.

Retains the right to bail for all persons before conviction, except capital offenses (where proof is positive or presumption great) and other felony offenses specifically prescribed by law when clear and convincing evidence shows no conditions of release can assure court appearance, community safety, or judicial integrity.

Requires that any statute designating felony offenses for pretrial detention without bail must be enacted by two-thirds majority vote of both houses of the General Assembly.

Clarifies that friends and counsel may have access to confined persons on reasonable conditions before conviction.

Requires passage of the constitutional amendment in two consecutive General Assemblies before and after a general election to take effect.
