SB 15 Summary

• Proposes a constitutional amendment to Article III, Section 10 of the Delaware Constitution requiring Senate confirmation of Governor's cabinet members and their reconfirmation at the beginning of each new Governor's term.

• Defines "members of the Governor's cabinet" as principal officers of executive departments made subject to this section by act of the General Assembly, and establishes that cabinet members serve at the Governor's pleasure during the Governor's term of office.

• Allows cabinet members to hold over for up to 90 days after a Governor's term expires while awaiting confirmation of a replacement or reappointment.

• Requires all cabinet members to become bona fide residents of Delaware within 6 months of appointment, with possible 6-month extension for good cause, and to maintain residency throughout their term; failure to obtain or maintain residency results in automatic resignation.

• Requires a two-thirds vote in both houses for passage as a constitutional amendment, with passage again required after the next general election to take effect.
