Allows employers to appeal denials of applications for comparable private plans under the Family and Medical Leave Program within 30 days of the Department's determination.

Transfers appeal hearing authority from the Family and Medical Leave Insurance Appeal Board to the Secretary of the Department of Labor, conducted under the Administrative Procedures Act (Chapter 101 of Title 29).

Exempts appeal hearings from public meeting requirements to protect confidential health and privacy information.

Makes appeal decisions final and binding unless appealed to Superior Court within 30 days of the decision date.

Applies to private benefits in existence on May 10, 2022, that the Department deems comparable to the FMLP, qualifying for a 5-year period from start of contribution payments if approval does not adversely impact Fund solvency.
