School districts, charter schools, and member schools must designate athletic teams or sports as either males/men/boys, females/women/girls, or coed based on students' biological sex.

Students must compete for athletic teams designated for their biological sex as stated on their birth certificate or other government record at or near the time of birth; scrivener or clerical error corrections are the only allowed modifications.

Female students may compete on male athletic teams only if the school does not offer a corresponding female team or sport.

Schools, governmental entities, and athletic associations are prohibited from taking adverse action against schools for complying with this chapter.

Students deprived of athletic opportunities due to violations, and schools harmed by violations, may bring civil lawsuits for injunctive relief, damages, reasonable attorney fees, and costs; actions must be filed within 2 years of the alleged harm.

The Delaware Interscholastic Athletic Association shall adopt regulations to implement and enforce this chapter, with implementation beginning in the 2024-2025 school year.
