Deletes the original class A misdemeanor penalty for official misconduct that was not properly struck by previous legislation, allowing the graded penalty system to apply correctly.

Establishes a tiered penalty structure for official misconduct violations: class A misdemeanor for paragraphs (a)(1)-(a)(2); class G felony for paragraphs (a)(3)-(a)(5); with enhanced penalties based on financial harm or underlying offense severity.

Adds "but less than $50,000" to class F felony definition to prevent overlap between felony classifications based on the value of personal benefit received or harm caused.

Restructures subsection (b) with introductory language clarifying when sentence enhancements apply for violations of paragraphs (a)(1) through (a)(5).

Makes technical corrections to conform the statute to Delaware Legislative Drafting Manual standards.
