DE SB3

Eliminates specific limitations on absentee voting in the Delaware Constitution and authorizes the General Assembly to enact laws establishing circumstances, rules, and procedures for absentee voting.

Requires all absentee ballots to include an oath or affirmation stating the voter's vote is free from improper influence, which replaces the oath required under Article V, Section 3 for absentee voters.

Removes outdated constitutional language listing specific reasons for absentee voting eligibility (public service, business, sickness, vacation, religious tenets) and grants the General Assembly flexibility to set eligibility criteria.

Requires a two-thirds majority vote in both houses of the General Assembly for passage, as mandated by Article XVI of the Delaware Constitution for constitutional amendments.

Constitutes the first leg of a constitutional amendment process requiring passage by the current General Assembly and passage again by the next General Assembly after the next general election to take effect.
