Changes the sterile needle and syringe program from a 1-for-1 exchange requirement to providing needles and syringes on an as-needed basis based on participant usage.

Authorizes the Director of the State Division of Public Health to designate private providers to operate the program while maintaining overall program administration.

Provides criminal liability exemptions for participants and program employees when possession or distribution of needles and syringes occurs in direct connection with authorized program activities.

Permits participants to return used needles and syringes at any available program site rather than being restricted to a single location.

Makes technical corrections to conform the statutory language to Delaware Legislative Drafting Manual standards.
