SB85 Summary

• Allows persons age 21 and older who are not prohibited persons to carry concealed deadly weapons without requiring a license, effective immediately upon meeting constitutional requirements under Delaware Constitution Section 20 and the U.S. Supreme Court's Bruen decision.

• Repeals the previous licensing scheme in § 1441 of Title 11 that required applications to Superior Court, certificates of good moral character, firearms training courses, and $65 fees.

• Maintains criminal penalties for carrying concealed firearms without authorization, with Class D felony charges if the weapon is a firearm and Class G felony for other deadly weapons.

• Updates background check provisions in §§ 1448A and 1448B to remove references to concealed carry permits as an exemption, while maintaining exemptions for law enforcement officers and other qualified individuals.

• Makes conforming amendments to Titles 9, 10, 22, and 24 to remove licensing requirements and permit-related references in county ordinances, municipal regulations, and business licensing provisions.
