SB 97 Summary

• Directs the Code Revisors to use "gender silent techniques" to eliminate masculine and feminine pronouns from Delaware Code, substituting nouns instead (e.g., replacing "he deems him qualified" with "the Governor deems the individual qualified").

• Authorizes Code Revisors to apply gender silent techniques to all laws enacted after the bill's effective date and optionally to existing laws enacted before that date.

• Establishes that gender silent techniques should only be used when pronouns are unclear; pronouns may remain when they apply to only one gender by necessity.

• Makes technical amendments to 140 sections across 15 Delaware Code titles to implement gender silent language throughout existing state law.

• Requires Code Revisors to report to the Director of the Division of Research any instances where gender silent application cannot be clearly determined, for possible correction through the legislative process.
