Specifies categories of persons required to complete fingerprint-based national criminal background checks for marijuana establishments: license applicants, workers (employees, contractors, volunteers), directors/officers/board members/agents, and persons with 10% or more ownership interest

Requires the State Bureau of Identification to provide ongoing monitoring of subsequent criminal history records, including through the FBI's Rap Back System, for individuals associated with marijuana establishments

Allows the Commissioner to refuse, suspend, or cancel licenses when applicants or key personnel with 10% or more ownership fail to meet background check requirements

Removes the definition of "work" that previously referenced Title 19 § 3302 from the marijuana control statute

Grants the Commissioner discretion to deny licenses to applicants who present a risk to health or public safety based on criminal background check information, and clarifies that prior marijuana-related convictions (rather than all controlled substance convictions) cannot alone be grounds for license denial
