Current Delaware Department of Education employees and individuals conditionally offered employment must submit to criminal background checks, including fingerprinting for both state and federal criminal history records

The Secretary may require contractors or third parties with access to student records to undergo criminal background checks

The State Bureau of Identification must provide ongoing criminal history monitoring through the Rap Back System, notifying the Department of any subsequent criminal records for current employees and contractors

Current employees and contractors must submit required background check information within 30 days of receiving the Department's written request

The Department may use criminal background information to determine qualification for employment or continued access to Department systems, facilities, or data
