Increases civil and administrative penalties for environmental violations from $1,000-$10,000 per day to $5,000-$40,000 per day across multiple sections of Delaware environmental law, including air quality, water pollution, and hazardous waste regulations

Raises the percentage of civil and administrative penalties directed to the Community Environmental Project Fund from 25% to 40%, while reducing the portion retained by the Department of Natural Resources and Environmental Control from 75% to 60%

Requires 40% of criminal penalties for air quality violations to be deposited in the Community Environmental Project Fund, with the remaining 60% appropriated to the Department

Expands the definition of chronic violator factors to include whether a violation constitutes a "High Priority Violation" according to the EPA, and adds "economic harm" as a consideration alongside economic benefit

Narrows eligibility for Community Environmental Project Fund expenditures to projects within a two-mile radius of the violation location, and requires the Secretary to notify eligible communities about the fund's availability
