Proposes a constitutional amendment to explicitly prohibit the death penalty in Delaware by adding "nor the death penalty imposed" to Article I, Section 11 of the Delaware Constitution

Removes language in Section 12 regarding bail exceptions for "capital offenses when the proof is positive or the presumption great," making all prisoners bailable by sufficient sureties

Requires two-thirds vote of all members elected to each house of the General Assembly for passage

Represents the "first leg" of a constitutional amendment, which must pass again in the next General Assembly following the next general election to take effect
