DE HB5

Creates the Joint Committee on Oversight of Agency Regulations, composed of 5 Senators and 5 Representatives (no more than 3 from the same party in each chamber), to review all state agency regulations

Requires all regulations adopted by agencies during the 12-month period before October 31 to automatically expire at 5:00 p.m. on the following June 30 unless the General Assembly passes legislation to remove the expiration

Committee must examine each regulation for statutory authority, compliance with legislative intent, economic impact on individuals/businesses/government, total regulatory costs, and benefits to Delaware residents

Committee staff must prepare a report by January 30 each year, followed by public hearings where agencies must present evidence; an affirmative vote of 7 committee members is required to recommend whether regulations should expire or continue

Agencies are prohibited from re-adopting regulations that the General Assembly allows to expire unless explicitly granted new authority through legislation amending the Delaware Code or Constitution
