School district public works projects costing $1 million or more must include a project labor agreement with the Delaware Building and Construction Trades Council, effective for contracts advertised after December 31, 2026.

The project labor agreement requirement does not apply when only one bid is received for a craft under the contract.

Project labor agreements must include guarantees against strikes and lockouts, procedures for resolving labor disputes, and provisions covering work at construction sites and custom fabrication work.

Agreements may include goals for participation by disadvantaged business enterprises (minority, women, veteran, disability-owned businesses) and allow contractors to retain a percentage of their current workforce.

The agreement binds all contractors and subcontractors on the project, and bid documents must include specifications to enforce this requirement.
