Prohibits Delaware school districts and charter schools from selling or serving breakfast, lunch, or competitive foods containing Red dye 40 (CAS no. 25956-17-6) on campus during the school day

Defines competitive foods as all foods and beverages other than federally reimbursed school meals, including vending machine items and a la carte offerings sold through school nutrition programs

Red dye 40 is a synthetic petroleum-derived food coloring used solely for appearance enhancement, found in cereals, beverages, gelatins, puddings, chips, dairy products, and confections

The Department of Education may adopt rules and regulations to implement the prohibition

Takes effect immediately upon passage, with implementation required beginning July 1, 2026, allowing a planning and preparation period for schools
