Increases penalty for second or subsequent violations of selling, giving, or serving alcoholic beverages to persons under 21 years of age from a second-degree misdemeanor to a first-degree misdemeanor if the violation occurs within 1 year after a prior conviction.

Establishes a complete defense to charges of serving alcohol to minors if the seller: (1) checked a valid government-issued ID; (2) reasonably believed the buyer appeared 21 or older; and (3) acted in good faith based on false evidence of age presented by the buyer.

Valid identification for the defense includes a driver's license, state identification card, passport, or United States Uniformed Services identification card.

Maintains existing exemption for licensed establishments and their employees or agents acting within the scope of their license when serving alcohol.

Takes effect July 1, 2010.
