Prohibits drivers from manually typing, entering characters, or reading text-based messages on wireless communications devices while operating a motor vehicle, including texting, e-mailing, and instant messaging.

Exempts emergency vehicle operators, law enforcement, fire service and emergency medical services professionals, and drivers reporting emergencies; also exempts navigation use, safety alerts, and voice-only communication.

Establishes violations as noncriminal traffic infractions (nonmoving violation for first offense, moving violation for second offense within 5 years), enforceable only as secondary action when driver is detained for another traffic violation.

Allows billing records and testimony from authorities as evidence of violations in any proceeding.

Adds unlawful use of wireless communications device resulting in a crash as a 6-point violation under Florida's driver's license point system, effective October 1, 2010.
