Expands the definition of "food establishment" under the Florida Food Safety Act to include tomato repackers in addition to tomato packinghouses

Authorizes the Department of Agriculture and Consumer Services to adopt food safety standards and conduct inspections of tomato farms, greenhouses, packinghouses, and repacking locations

Establishes administrative fines up to $5,000 per violation for non-compliance with tomato food safety rules

Creates a presumption that tomatoes are safe for human consumption when producers document compliance with department rules, good agricultural practices, and best management practices

Exempts small-scale sales (up to two 25-pound boxes per customer per day) at farmers' markets, U-pick operations, roadside stands, and on-premises grower sales from food safety standards
