Reclassifies unlawful operation of soundmaking devices in motor vehicles from a nonmoving violation to a moving violation, which includes assessment of points against the driver's license.

Establishes enhanced penalties for repeat violations within a 12-month period: $120 for a second violation and $180 for a third or subsequent violation of the soundmaking device statute.

Maintains existing prohibitions on operating radios or other soundmaking devices so that sound is plainly audible at 25 feet or more away, or louder than necessary near churches, schools, or hospitals.

Requires the Department of Highway Safety and Motor Vehicles to establish rules defining "plainly audible" and standards for how law enforcement should measure sound.

Takes effect July 1, 2010.
