Prohibits retail sales of smoking pipes and smoking devices unless the seller holds a retail tobacco products dealer permit under Florida law.

Requires sellers to derive either at least 75 percent of annual gross revenues from cigarettes, cigars, and tobacco products, or no more than 25 percent of revenues from the regulated smoking devices.

Regulates specific items including metal/wooden/glass pipes, water pipes, bongs, chillums, ice pipes, carburetion tubes, chamber pipes, electric pipes, and air-driven pipes.

Establishes violation as a first-degree misdemeanor, punishable according to Florida Statutes sections 775.082 or 775.083.

Takes effect July 1, 2010.
