Amends Florida law to require special elections or special primary elections to fill vacancies in Florida's U.S. Senate representation, in addition to existing requirements for U.S. House vacancies.

Exempts the Governor from calling a special election to fill a U.S. Senate vacancy if no session of Congress is scheduled during the unexpired portion of the term.

Modifies the process for determining whether a special election is required by referencing upcoming sessions of Congress as applicable, similar to existing state legislative vacancy rules.

Repeals section 100.161, Florida Statutes, which previously addressed filling vacancies in Florida's U.S. Senate representation.

Takes effect July 1, 2010.
