Amends Florida Statute 316.027 to require defendants arrested for leaving the scene of a fatal vehicle crash to be held in custody until brought before a judge for bail consideration.

Applies the mandatory custody requirement only to those with prior convictions for violations of sections 316.027, 316.061, 316.191, 316.192, 316.193, or 322.34.

Maintains existing penalty that willfully leaving the scene of a fatal crash is a first-degree felony punishable under sections 775.082, 775.083, or 775.084.

Requires a mandatory minimum sentence of 2 years imprisonment when the violation occurs while driving under the influence.

Takes effect July 1, 2010.
