County governing bodies with existing enterprise zones that include rural areas of critical economic concern may apply to the Office of Tourism, Trade, and Economic Development to expand zone boundaries by up to 3 square miles.

Office of Tourism, Trade, and Economic Development may approve boundary expansion requests if the expanded area meets all requirements under s. 290.0055, Florida Statutes, except area limitations.

Martin County may apply for designation of one enterprise zone covering up to 10 square miles in the Indiantown area within the primary urban services boundary, with specific exclusions for Florida Power and Light property, estate residential areas, and the county-owned Timer Powers Recreational Area.

Martin County must exempt residential condominiums from state enterprise zone incentives within its designated zone unless prohibited by law.

Martin County's enterprise zone application must be submitted by December 31, 2010, and the Office of Tourism, Trade, and Economic Development shall establish the effective date upon designation.
