Changes the source for written statements required for expunction certificates from state attorney/statewide prosecutor to clerk of court in s. 943.0585(2)(a).

Allows a second expunction of a criminal history record if the person has had only one prior expunction or sealing, has not been arrested in the prior 10 years, and has not previously sealed or expunged a record involving the same offense.

Allows a second sealing of a criminal history record if the person has had only one prior expunction or sealing, has not been arrested in the prior 5 years, and has not previously sealed or expunged a record involving the same offense.

Modifies the restriction on prior sealing or expunction to permit exceptions for second expunctions and sealings under new subsections (5) in both s. 943.0585 and s. 943.059.

Effective date: July 1, 2010.
