Authorizes Class I landfills to accept yard trash if the facility has an active gas-collection system that collects landfill gas and arranges for beneficial reuse of that gas.

Allows Class I landfills to accept yard trash for mulching and use as landfill cover for municipal solid waste.

Requires the Department of Environmental Protection to develop a methodology by rule to award recycling credit for yard trash disposal at Class I landfills with gas-collection systems.

Requires qualifying Class I landfills to obtain a minor permit modification describing the beneficial use of landfill gas and modifying the facility's operation plan before accepting yard trash.

Permits incidental amounts of yard trash in Class I landfills at most local government units, except counties operating under a 1956 constitutional home rule charter; does not intend to materially impact existing waste-to-energy or biomass facilities.

Effective July 1, 2010.
