Removes requirement that water management district governing boards must delegate permitting authority to executive directors, making such delegation optional rather than mandatory.

Eliminates prohibition on reviewing delegations under chapter 120 (Administrative Procedure Act), allowing board delegations to be subject to rulemaking requirements.

Requires governing boards to establish a process for referring permit application and variance petition denials back to the board for final action when authority has been delegated.

Removes restriction preventing board members from intervening in permit applications prior to referral to the board for final action.

Takes effect July 1, 2010.
