HB 745 Summary

• Extends sealed bid and proposal exemptions from public records disclosure until an agency provides notice of contract award decision, or 20 days after bid opening (increased from 10 days), and clarifies exemption applies to public-private transportation facility procurements under s. 334.30.

• Creates exemption from public meeting requirements for meetings where vendors make oral presentations or answer questions about their sealed bids, proposals, or replies, and for meetings where vendors present alternate technical concepts.

• Requires complete recordings of all exempt vendor presentation meetings with no off-the-record portions allowed.

• Makes meeting recordings and all documents/materials generated from exempt vendor meetings temporarily exempt from public records disclosure until contract award notice or 20 days after bids open, whichever is earlier; exemption expires after 12 months if all bids are rejected.

• Establishes that "notice of decision or intended decision" means the final contract award to vendor(s), not intermediate decisions like vendor short-listing; exemptions sunset October 2, 2015 unless reenacted; effective July 1, 2010.
