Requires the Department of Health to mandate that food service establishments display calorie counts for standard food items on menus or menu boards in a clear and conspicuous manner prior to purchase.

Allows calorie information to be displayed adjacent to items/prices, on separate signs, at point-of-purchase, or through electronic means accessible to consumers.

Exempts not-for-profit food establishments, food offered at no cost, and foods exempted by the State Surgeon General by rule.

Establishes enforcement through routine inspections with a 90-day warning period before administrative fines of $100 per day begin for non-compliance, and provides liability protection unless violations are knowing and willful.

Applies to establishments with 20+ locations statewide beginning January 1, 2011, and to all food service establishments statewide beginning January 1, 2012; may be superseded if federal law establishes a consistent national nutrition labeling standard.
