CS/CS/HB 787 - Child Abduction Prevention Act

• Authorizes courts to impose restrictions in parenting plans upon competent substantial evidence or court finding of credible risk that a party may remove a child from Florida/the country or conceal the child's whereabouts.

• Expands who may request restrictions to include "another individual or entity having a right under the law of this state" in addition to the existing parties.

• Allows courts to require passport surrender, placement in the Children's Passport Issuance Alert Program, or prohibition on passport/visa applications as alternatives or in addition to bond requirements.

• Establishes extensive factors courts may consider when assessing abduction risk, including previous removal attempts, family ties, financial incentives, criminal history, domestic violence, immigration status changes, and likelihood of taking child to non-Hague Convention countries or countries with poor enforcement records.

• Permits forfeiture of posted bond to reimburse recovery costs, attorney's fees, and damages; violations may result in civil/criminal penalties and federal charges under the International Parental Kidnapping Crime Act; exempts domestic violence victims from bond requirements.
