Repeals section 768.21(8) of Florida Statutes, which previously prevented adult children and parents of adult children from recovering wrongful death damages in medical negligence claims.

Amends sections 400.023, 400.0235, and 429.295 to remove references to the repealed section 768.21(8) and clarify that actions under these parts are not medical malpractice claims.

Removes language stating that section 768.21(8) does not apply to claims alleging death of residents in long-term care facilities and assisted living facilities.

Effective date is July 1, 2010.
